terms of service

These Terms of Service (“Terms”) are a legal agreement between you and [Legal Entity Name — to be confirmed] , operating as vybedrop (“we,” “us,” or “our”), governing your use of the vybedrop mobile app, app.vybedrop.com, and vybedrop.com (together, the “Service”). By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

vybedrop is currently in open beta. Features, limits, and these Terms may change as we build. We’ll do our best to give notice of material changes, but beta software can be unpredictable — see “disclaimers” below.

You must be at least 13 years old (or the minimum age required in your country) to use vybedrop, and you must have the legal capacity to enter into these Terms. By using the Service, you represent that you meet these requirements.

You’re responsible for the information you provide when creating an account, for keeping your sign-in method (email, Google, or Apple) secure, and for all activity that happens under your account. Tell us right away at hello@vybedrop.com if you suspect unauthorized use of your account.

vybedrop lets you create or join small private groups (“tribes”) and share photos and videos (“drops”) with the other members of a tribe. Tribes can run recurring prompts (“rituals”) and members can react to drops (“vybes”). A tribe’s creator controls its name, how members join (open or by approval), and, when the tribe’s time is up, whether it is archived or dissolved (see “tribe lifecycle” below).

You own the photos, videos, captions, and other content you post to vybedrop (“Your Content”). By posting Your Content to a tribe, you grant:

• the other members of that tribe a license to view, save, and react to Your Content for as long as they remain a member and the content remains available; and
• vybedrop a worldwide, royalty-free license to host, store, reproduce, and display Your Content solely as necessary to operate and provide the Service to you and your tribe (for example, resizing an image for a thumbnail, or generating an archive-mode export).

We don’t use Your Content for advertising, and we don’t sell it. You’re responsible for making sure you have the rights to post whatever you post, and that it doesn’t violate anyone else’s rights.

By using vybedrop, you agree not to:

• post content that is illegal, harassing, hateful, sexually exploitative of a minor, or that infringes someone else’s intellectual property or privacy rights;
• impersonate another person or misrepresent your affiliation with anyone;
• use the Service to bully, threaten, or harass another member;
• attempt to access another user’s account or tribe without authorization;
• reverse-engineer, scrape, or interfere with the operation of the Service; or
• use the Service in a way that violates applicable law.

You can report a drop or a member, or block another member, directly in the app. We review reports and may remove content, suspend, or terminate accounts that violate these Terms, at our discretion and without prior notice where we believe it’s necessary to protect other users or the Service.

Every tribe has a timer set by its creator. When it ends, the host chooses to:

• archive the tribe — it becomes read-only and its drops remain visible to members until a member deletes their account or the content is otherwise removed; or
• dissolve the tribe — access to its drops ends for members, and the content is queued for permanent deletion from our systems, subject to a short grace period.

We are not responsible for content lost when a tribe is dissolved, when a member leaves or is removed, or when an account is deleted. Members are responsible for saving anything they want to keep before a tribe’s window closes.

Because vybedrop is in active development, we may add, change, or remove features, impose limits, or discontinue the Service (or any part of it) at any time. We’ll try to give notice of changes that materially affect you, but we can’t guarantee it.

You can stop using vybedrop and delete your account at any time from Settings. We may suspend or terminate your access to the Service if we reasonably believe you’ve violated these Terms, misused the Service, or created risk or legal exposure for us or other users. Sections of these Terms that by their nature should survive termination (including “your content and license to us,” “disclaimers,” “limitation of liability,” and “governing law”) will survive.

The service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that content will be preserved without loss.

To the fullest extent permitted by law, vybedrop and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, content, goodwill, or profits, arising out of or related to your use of the service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of these terms or the service will not exceed the greater of one hundred u.s. dollars ($100) or the amount you paid us, if any, in the twelve months before the claim arose.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

You agree to indemnify and hold vybedrop and its operators harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.

These Terms are governed by the laws of [State/Country — to be confirmed by counsel], without regard to conflict-of-law principles. Any dispute arising out of these Terms or the Service will be resolved in the courts located in that jurisdiction, and you consent to their personal jurisdiction.

We may update these Terms from time to time. If we make material changes, we will update the “last updated” date above and, where appropriate, notify you in the app. Continuing to use vybedrop after changes take effect means you accept the updated Terms.
